8. PURCHASES ON THIS WEBSITE AGREE TO THE FOLLOWING:

A. PROJECT SPECIFIC EXCLUSIONS Any materials not related to the water filter installation (4 stage water filter system, pipe and fittings) are not included as a part of this agreement B. STANDARD EXCLUSIONS Unless specifically included in the “General Scope of Work” section above, this Agreement does not include labor or materials for the following work: Site Plans, engineering fees, or governmental permits and fees of any kind. Testing, removal and disposal of any materials containing asbestos (or any other hazardous material as defined by the EPA). Custom milling of any wood for use in project. Moving Owner’s property around the site. Labor or materials required to repair or replace any Owner-supplied materials. Repair of concealed underground utilities not located on prints or physically staked out and exposed by Owner, which are damaged during construction. Correction of concealed substandard framing. Rerouting/removal of vents, pipes, ducts, structural members, wiring or conduits, steel mesh which may be discovered in the removal of walls or the cutting of openings in walls. Failure of surrounding part of existing structure, despite Change Your Bathroom’s good faith efforts to minimize damage, such as plaster or drywall cracking and popped nails in adjacent rooms or blockage of pipes or plumbing fixtures caused by loosened rust within pipes. Exact matching of existing finishes; repair of damage to roadways, driveways, or sidewalks that could occur when construction equipment and vehicles are being used in the normal course of construction. C. DATE OF WORK COMMENCEMENT AND SUBSTANTIAL COMPLETION Work will tentatively start after payment is received and an agreed upon date. D. CHANGE ORDERS: CONCEALED CONDITIONS AND ADDITIONAL WORK i. CONCEALED CONDITIONS This Agreement is based solely on the observations Change Your Bathroom was able to make with the structure in its current condition at the time this Agreement was bid. If additional concealed conditions are discovered once work has commenced which were not visible at the time this contract/proposal was bid, CYB will stop work and point out these unforeseen concealed conditions to Owner so that Owner and CYB can execute a Change Order for any Additional Work. ii. DEVIATION FROM SCOPE OF WORK Any alteration or deviation from the Scope of Work referred to in this Agreement involving extra costs of materials or labor will be executed upon a written Change Order issued by Change Your Bathroom and should be signed by Change Your Bathroom and Owner prior to the commencement of Additional Work by CYB. All work will be performed will be agreed to in writing. There will be no verbal agreements, expressed or implied. E. PAYMENT SCHEDULE AND PAYMENT TERMS i. PAYMENT SCHEDULE b. Change Your Bathroom requires 100% payment up front for water filter systems and installation. PAYMENTS ARE NON-REFUNDABLE. ii. PAYMENT OF CHANGE ORDERS All Change Order(s) will be signed and paid in full at substantial completion of the work order, unless monies are required for the ordering of materials. All change orders will be submitted to Owner(s) for approval before work begins. Any material(s) which increases in price more than 1 ½ % from time of contract signed date, Change Your Bathroom may pass this cost to Owner in the form of a Change Order provided CYB provides written proof of price increase. Fuel prices at this time are causing increases in delivery/shipping charges (lumber shipped and delivered resulting in lumber price increases), petroleum products (asphalt shingles, plumbing materials – PVC pipe, etc) CYB has no control over the matters and will not be held responsible or liable to shoulder the burden of these expenses after contract is signed. Owner agrees to pay price increase(s) provide CYB provides verifiable documentation. All change orders are payable in full upon completion of the unit of work involved. F. WARRANTY Change Your Bathroom provides a limited 5 year warranty on all labor preformed on project; the warranty will only include defects in workmanship. Change Your Bathroom provides 1 warranty on the water filter system furnished by CYB and no warranty on any Owner Supplied Materials. No warranty is provided on any existing materials that are moved and/or reinstalled by CYB within the dwelling (including any warranty that existing/used materials will not be damaged during the removal and reinstallation process). The Owner’s sole remedy on all materials that are covered by a manufacturer’s warranty is strictly with the manufacturer, not with Change Your Bathroom
THE EXPRESS WARRANTIES CONTAINED HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, HABITABILITY, OR FITNESS FOR A PARTICULAR USE OR PURPOSE. THIS LIMITED WARRANTY EXCLUDES CONSEQUENTIAL AND INCIDENTAL DAMAGES AND LIMITS THE DURATION OF IMPLIED WARRANTIES TO THE FULLEST EXTENT PERMISSIBLE UNDER STATE AND FEDERAL LAW. 8. WORK STOPPAGE, TERMINATION OF CONTRACT FOR DEFAULT, AND INTEREST Change Your Bathroom shall have the right to stop all work on the project and keep the job idle if payments are not made to Change Your Bathroom in accordance with the Payment Schedule in this Agreement, or if Owner repeatedly fails or refuses to furnish Change Your Bathroom with access to the job site and/or product selections or information necessary for the advancement of Change Your Bathroom’s work. Simultaneous with stopping work on the project, Change Your Bathroom must give Owner written notice of the nature of Owner’s default and must also give the Owner a 14-day period in which to cure this default. If work is stopped due to any of the above reasons (or for any other material breach of contract by Change Your Bathroom) for a period of 14 days, and Change Your Bathroom has failed to take significant steps to cure his default, then Change Your Bathroom may, without prejudicing any other remedies Change Your Bathroom may have, give written notice of termination of the Agreement to Owner and demand payment for all completed work and materials ordered through the date of work stoppage, and any other loss sustained by Change Your Bathroom. Thereafter, Change Your Bathroom is relieved from all other contractual duties, including all Punch List and warranty work on any work not completed by Change Your Bathroom. Owner shall have the right to terminate this Agreement if Change Your Bathroom fails to prosecute the Scope of Work for a period of 14 consecutive days; provided however, Owner may not terminate this Agreement if such failure is a result of force majeure (with financial incapacity not being a force majeure event) or if Owner does not furnish Change Your Bathroom with access to job site or provide Change Your Bathroom with product selections or information necessary for the advancement of the Scope of Work. To terminate this Agreement pursuant to the preceding sentence, Owner must give Change Your Bathroom written notice no less than 5 days prior notice of Owner’s intent to terminate this Agreement, which notice may be given at any time. If Owner terminates this Agreement pursuant to the first sentence of this paragraph, Owner shall have all other remedies available at law or in equity. G. DISPUTE RESOLUTION AND ATTORNEY’S FEES Any controversy or claim arising out of or related to this Agreement involving an amount of less than $15,000 (or the maximum limit of the court) must be heard in the Small Claims Division of the Municipal Court in the county where Change Your Bathroom’s office is located (Fulton County). Any controversy or claim arising out of or related to this Agreement which is over the dollar limit of the Small Claims Court must be settled by binding arbitration administered by the American Arbitration Association in accordance with the Construction Industry Arbitration Rules or in a court of competence of jurisdiction at owners discretion. Judgment upon the award may be entered in any Court having jurisdiction thereof. The prevailing party in any legal proceeding related to this Agreement shall be entitled to payment of reasonable attorney’s fees, costs, and expenses. The general contractor shall provide to the home owner upon request a signed lien wavier from the subcontractor indicating the subcontractor has been paid for all labor and materials. H. ENTIRE AGREEMENT This Agreement represents and contains the entire agreement between the parties. Prior discussions or verbal representations by the parties that are not contained in this Agreement are not a part of this Agreement. Owner and Change Your Bathroom have discussed completion/finishing areas on plans which show unfinished. BY PAYING THROUGH THIS WEBSITE BUYER/OWNER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTAND AND AGREE TO, ALL THE TERMS AND CONDITIONS CONTAINED IN THE AGREEMENT ABOVE.

Please note that your use of this site constitutes your unconditional agreement to follow and be bound by these Terms and Conditions. Although you may “bookmark” a particular portion of this site and thereby bypass this agreement, your use of this site still binds you to the Terms.

Shipping and Lead Times

Production and Shipping Lead Times

Please be advised that vanities are handcrafted and manufactured to order. Lead times may vary and are only estimates. Please do not arrange for an install until you have received all correct items from your order. Before assembly or installation, check to see that you have all of the components to your order. CHANGE YOUR BATHROOM will not be responsible for any contractor expenses and/or other fees incurred outside of your transaction with CHANGE YOUR BATHROOM. If multiple items are ordered at the same time, then CHANGE YOUR BATHROOM has the right to combine shipments together on the same date. In this circumstance customers should base their estimated lead time off of the vanity’s production time and not the other items production time.

For standard orders, items can take 14-21 business days to manufacture and may be shipped via UPS or USPS ground. Freight shipping may be used when an order exceeds the capacity of UPS or USPS. Once your items have been manufactured, it will ship via ground delivery service or freight shipping. If you require a production and or shipping method other than standard production and standard ground shipping service, please contact us within 24 hours of receipt of this order invoice to request expedited shipping. Shipping lead times are approximate and are not guaranteed.

LED Lit Glass manufacturing is estimated at:

Custom vanities and LED Glass: Design & Drawing process varies by project, after approval by customer typical lead time is 2-4 weeks

Cancelled Orders

Please note that all sales orders placed will have until the close of the following business day to be cancelled with a 5% cancellation fee. This must be done over the phone (no other form of communication will be accepted). All orders cancelled after the following business day are subject to restocking fees.

30-Day Return/Exchange

If your product has a defect or needs to be exchanged you must do it within 30 days of receiving your order. No returns will be accepted after 30 days or if the product has been installed. To ensure you’ve received all the correct components, please plan the installation of your product within the first 30 days of receiving your order in case you need any exchanges or additional items for installation. Returns will be subject to a 25% restocking fee and exchanges will be subject to a 20% restocking fee. Custom orders are not returnable.

Online Orders

It is the consumer’s responsibility to understand what they are ordering when using the online system. CHANGE YOUR BATHROOM has provided many online photo resources and descriptions to help you during your order. Please read these descriptions carefully. Shipping Methods

All free shipping will be shipped via ground shipping or freight shipping. Ground shipping/freight shipping will deliver your product to your door or to the “curb” for large items. It is the consumer’s responsibility to arrange for installation and delivery beyond the curb. Please do not schedule the installation for your item(s) until they have arrived.

Expedited shipping options may be available for an additional fee. Expedited shipping may be limited due to the weight of certain products. If you require expedited shipping please call CHANGE YOUR BATHROOM at 770-272-4614for more information.

Product Substitution

In the event that your specific product is no longer available, CHANGE YOUR BATHROOM reserves the right to substitute the part with a comparable product in quality, style and color.

Vanity Finishes and Wood Texture

The colors on our website represent an approximate color and we cannot guarantee the finish color. Due to screen limitations, colors seen here may not accurately reflect painted colors. Please order a sample in advance of ordering the item if you would like to see the actual color.

Limited 1 Year Warranty

All products come with a limited 1-year warranty that covers the functionality of our products. This warranty does not cover finishes, cosmetic discoloration, damage, improper installation or normal wear. We will replace any part that fails to function properly with the return of the failed product.

International Shipping

We currently do not offer international shipping.

Returns

Please adhere to the following return policy:

The following items may be returned for a refund:

• Merchandise that has not been removed from its original packing.
• Defective merchandise.
• Merchandise that has not been installed.

A 15% restocking fee will be charged on all returned merchandise, unless defective.

We are not responsible for any labor costs, which occur as the result of the installation of wrong or defective parts. In addition we are not responsible for lost shipments. You must file a lost shipment freight claim with the respective shipper.

Exceptions

• Clearance items are not eligible for return unless defective. Please be aware that due to the nature of clearance sales, the item immediately falls under manufacturer warranty.
• Returns can only be made within 30 days of receiving your product(s).
• All returns must be over $15 in total value. Any return for less than this total amount may not be permitted.
• Merchandise must have not been damaged in freight transit.
• Custom cut or custom made products.

Some items CHANGEYOURBATHROOM.COM sells are not available in our web catalog but can be purchased over the phone. If you purchase a special order item by contacting or calling our toll-free number it may not be returnable or may be subject to a higher restocking fee. When you call, a sales associate will notify you of any applicable return charges. If defective, you may only exchange these items for the same product. Please call our customer service number if you are uncertain about any part of this return policy or if you have unanswered questions.

General

We can process returns and refunds only for items purchased from CHANGEYOURBATHROOM.COM or one of its affiliates. To receive a refund, all returned merchandise must be in resalable condition, free from scratches and defects.

If your product is defective, CHANGEYOURBATHROOM.COM has simplified the return process. We now offer pre-paid labels (PPLs) on all general returns just by setting up a return through the call center. The cost to ship the item back to us is deducted from the credit the customer receives once the item is returned.

You can also cancel items that have not been shipped yet. To cancel an order that has not yet shipped, please call our customer service department immediately. Once an item or an order has been shipped it cannot be canceled, and you will have to process a general return.

Returns Via Mail

Follow the simple directions below to make your return by mail:

• Contact our returns department by telephone or web interface to process your return and receive an RGA (return goods authorization) number. Once you have set up your return by phone you will be e-mailed an RGA number within 2 business days. Along with this return number you will receive a ship-to address where you must send your merchandise to. Be sure to include your RGA number with your merchandise. This number will be used to guarantee you receive your credit. Note: If you return a product to us without an RGA number, your return could be subject to additional restocking fees.
• Include all original packing materials, manuals and accessories with the product to avoid any additional fees.
• We recommend items be returned via UPS or insured parcel post for proof of delivery. Please be certain that items are secure in their packaging so damage does not occur while they are in transit back to our warehouse.
• You are responsible for all freight charges. However, you will be credited all reasonable and customary freight charges relevant to that item if product is defective or the wrong item was shipped.
• Items received past the return period plus reasonable shipping time may not be processed. Only items purchased from CHANGEYOURBATHROOM.COM are eligible for return credit. Returned items must be shipped in the original product packaging. Notification will be sent to the e-mail and/or billing address provided should your return not be accepted. Items will be resent to you upon receipt of your payment of freight charges. Items will be deemed abandoned if we are not contacted within 30 days.

Refunds

We will notify you via e-mail of your refund once we have received and processed the returned item. Please note: we will refund shipping costs only if the return is a result of our error.

We will do our best to process the return quickly. Please allow 14-21 days for processing. Refunds will be credited to the original purchasing credit card account number only. If you paid by check please allow an additional 14-21 days for delivery of check via USPS.
